(every node counts here) is the trading name and brand under which ENACHE MARIO-ANDREI PERSOANA FIZICA AUTORIZATA, with registered office at B-dul Bucurestii Noi nr. 136, sector 1, Bucharest, Romania, registered in the Trade Register under no. F2026012267008, Tax ID 54189465, email [email protected], conducts its commercial activity. Any reference to "ench." in this document corresponds legally to the sole trader identified above.
This document establishes the legal terms and conditions applicable to services we supply through the website www.ench.ro and other available channels.
By accessing and using the services we offer, you explicitly accept the terms and conditions set forth in this document. ench. provides services in accordance with these regulations and with applicable legislation in force in Romania.
Definitions
- -Provider - ENACHE MARIO-ANDREI PERSOANA FIZICA AUTORIZATA, operator of the services
- -Client - individual or registered business that uses or benefits from the "services"
- -Services - digital products provided through the ench. infrastructure
- -Third Parties - third-party companies offering digital services (Cloudflare, Google, etc.)
Services
- -Web hosting
- -Game hosting
- -Virtual private servers (VPS)
- -Dedicated servers
- -Domain registration
- -Control panels and related applications
- -Web and application development
- -System maintenance and administration
Account creation
To benefit from services, creating a customer account is required.
You commit to:
- -providing complete, accurate, and verified information;
- -periodically updating the provided data if it no longer reflects reality.
Providing false or incomplete information may lead to:
- -account suspension
- -service cancellation
- -refusal of future service provision
You are responsible for the security of:
- -authentication data (internal and "third party")
- -SSH keys
- -account access
Any activity carried out through your account is considered to have been performed by you. You assume full responsibility for maintaining the confidentiality of your access data and for all actions taken through your account.
Business accounts and verification
Customers requesting invoicing to a legal entity must provide accurate, current company details: full legal name, VAT/registration number, company registry details and registered office address.
We reserve the right to request additional documentation to verify the business before enabling B2B invoicing, or at any time afterwards, including:
- -the certificate of incorporation or its equivalent
- -a recent extract from the companies register
- -proof that the person ordering is authorised to represent the company
- -proof of the registered office address
We reserve the right to refuse or close a business account, without compensation, where:
- -company details are false, incomplete or cannot be verified
- -requested documents are not provided within a reasonable period
- -the company is struck off, fiscally inactive or insolvent
- -there are indications of fraud, identity theft, or use of a corporate identity belonging to someone else
- -the company is registered in an offshore jurisdiction, or in a structure that prevents identification of the beneficial owner, and the customer cannot clarify this on request
Verification exists to issue legally valid fiscal documents and to prevent fraud. Documents provided are processed in accordance with our Privacy policy and retained only as long as necessary for that purpose.
Services provided
ench. offers digital services intended for hosting applications and online services, as per section 2.1. Services are delivered immediately after payment confirmation or after manual processing by us.
Unmanaged services
Services of the type VPS, dedicated server, and custom game server are considered unmanaged services.
You are responsible for:
- -operating system installation
- -software configuration
- -server security
- -application updates
- -administration of installed services
We assume no responsibility for the configuration or maintenance of software you install.
Resource usage
Resources allocated to a service (CPU, RAM, storage, bandwidth) represent maximum limits, not guaranteed minimums.
Sustained high resource usage that affects the performance of other clients or the stability of shared infrastructure may result in:
- -migration of the service to dedicated infrastructure
- -requirement to upgrade to a higher plan
- -temporary resource usage limits being applied
We will notify you in advance where possible before taking any of the above measures.
Payment & billing
All services are provided on a prepaid basis, except under contracts.
Payment for services is required before activation or before renewal.
Payment methods may include:
- -bank card
- -bank transfer
- -online payment processors
Invoices are generated electronically and are available in your account.
Unpaid invoices
In the event that an invoice is not paid by the deadline:
- 1.The service may be automatically suspended.
- 2.After an additional period determined by the provider, the service may be terminated and permanently deleted.
We assume no responsibility for data loss caused by non-payment of services.
Refund policy
The services offered represent remotely provided services, in accordance with consumer protection legislation.
Pursuant to OUG 34/2014 art. 16 para. a), the 14-day right of withdrawal does not apply once service provision has commenced, provided you requested immediate activation and confirmed you understand you lose your right of withdrawal upon service activation.
By placing the order and requesting immediate service activation, you express your consent for service execution to begin before the legal withdrawal period expires.
Refunds may be made exclusively in the following cases:
- -service unavailability below the level guaranteed in the SLA per section 7.
- -provider's inability to deliver the service
Compensation is offered in the form of account credit or refund.
Service level agreement (SLA)
We guarantee infrastructure availability of 99.90% monthly uptime.
Real-time infrastructure status is publicly available at status.ench.ro.
Compensation is granted upon your request, submitted within 7 days of the incident:

Not included in the SLA calculation:
- -scheduled maintenance
- -DDoS attacks
- -client-caused errors
- -force majeure events
Acceptable use policy (AUP)
Use of the services for the following purposes is strictly prohibited:
- -spam
- -phishing
- -malware
- -botnets
- -DDoS attacks
- -brute force
- -network scanning
- -exploiting vulnerabilities
- -distributing illegal content
- -hosting pirated content
- -distributing copyrighted content
- -unauthorized crypto mining
We reserve the right to suspend services involved in such activities, per section 13, and to provide all necessary information in the event of an investigation by competent authorities.
Abuse reports
We may receive abuse complaints regarding services hosted on our infrastructure.
Reports may be submitted to [email protected] and should include relevant technical information (IP address, timestamps, logs or evidence).
Upon receiving a report, we may investigate the activity associated with the service. If a violation of the Acceptable use policy (AUP) or applicable law is reasonably suspected, we may take action in accordance with section 13 (Service suspension).
You agree to cooperate with abuse investigations and to respond to abuse-related inquiries within a reasonable timeframe.
We may preserve and disclose relevant technical information to competent authorities where required by law.
Infrastructure monitoring
To protect the network and prevent abuse, we reserve the right to monitor:
- -network traffic
- -resource usage
- -suspicious activities
Monitoring is performed exclusively for technical and security purposes, in compliance with EU Regulation 2016/679 (GDPR).
Backup
Backups we provide are considered auxiliary services.
We do not guarantee their availability or integrity.
You are responsible for maintaining your own backup copies.
Limitation of liability
We cannot be held liable for:
- -financial losses
- -data losses
- -service interruptions caused by third parties
- -cyberattacks
- -client software errors
Maximum liability cannot exceed the amount paid for the affected service, to the extent permitted by applicable law.
Service suspension
We may suspend services without notice in the case of:
- -illegal activities
- -infrastructure abuse
- -legal complaints
- -security risks
Intellectual property
All website elements, including:
- -text
- -graphics
- -software
- -applications
are our property or the property of our partners. Copying or redistribution without written consent is prohibited.
Data protection
Personal data is processed in accordance with EU Regulation 2016/679 (GDPR).
Data is used for:
- -billing
- -technical support
- -client communication
You have the right to:
- -access — request a copy of the personal data we hold
- -rectification — request correction of inaccurate or incomplete data
- -erasure — request removal of data, subject to legal obligations
- -restriction — limit how we process your data
- -portability — receive your data in a structured, machine-readable format
- -objection — object to processing based on our legitimate interest

Force majeure
We are not responsible for failure to fulfil obligations caused by force majeure events.
These include:
- -natural disasters
- -cyberattacks
- -global internet outages
- -governmental actions
Modification of terms
We reserve the right to modify these terms and conditions.
The updated version will be published on the website with an unique fingerprint and will be sent by email. If you do not agree with the changes, you may terminate the contract without penalties.
Applicable law
These terms and conditions are governed by Romanian law.
Any dispute will first be addressed through amicable negotiation between the parties. If no resolution is reached within 30 days, the matter will be submitted to the competent courts of Romania.
